This Third‑Party Marketplace Subscription Agreement applies to subscriptions for Brighten Learning mobile applications purchased through third‑party marketplaces, including but not limited to the Apple App Store and Google Play Store.
By purchasing, accessing, or using a Brighten Learning application through a third‑party marketplace, you acknowledge that you have read, understand, and agree to this Agreement.
- Nature of the Subscription
- A third‑party marketplace purchase provides a time‑limited subscription granting access to a Brighten Learning mobile application during the active subscription period.
- This subscription is not a sale of the application, software, or content.
- No ownership, perpetual, or post‑subscription access rights are granted.
- Access automatically ends when the subscription expires, is canceled, or is otherwise terminated.
- Brighten Learning may modify, update, suspend, or discontinue application content, features, or availability at any time.
- Account‑Based Access
- Subscriptions are tied exclusively to the individual user account that completed the purchase through the applicable marketplace.
- Subscriptions may not be transferred, shared, sublicensed, or reassigned to another user or account.
- The purchaser is responsible for maintaining control of their user account credentials.
- Device Use and Session Control
- The purchasing user account may be used to sign in on different devices; however, the subscription is intended for single‑user access.
- This subscription is not designed or supported for simultaneous or ongoing use across multiple devices.
- Brighten Learning may limit concurrent sessions, revoke access, terminate sessions, or log users out to enforce single‑user use.
- Session termination or logout may occur automatically and without prior notice.
- Device switching using the same user account is permitted at the user’s discretion and risk.
- Platform and Marketplace Restrictions
- Subscriptions are valid only on the platform and marketplace where the purchase was made.
- Apple App Store subscriptions are valid only on Apple platforms.
- Google Play Store subscriptions are valid only on Android platforms.
- Cross‑platform or cross‑marketplace use, including Apple to Android or Android to Apple, is not supported or permitted.
- Scope of Access
- Third‑party marketplace subscriptions grant access to the individual user version of a Brighten Learning application.
- Subscriptions are single‑user and non‑transferable.
- No multi‑user management, shared access, administrative dashboards, or organization‑level features are included.
- Managed, classroom, multi‑device, or organizational access requires a separate direct agreement with Brighten Learning.
- Intended Use
- Third‑party marketplace subscriptions are intended for individual learner or home use.
- This version is not designed, recommended, or supported for institutional deployment or program‑wide instructional use.
- Institutional purchases for individual users are allowed but do not include institutional support or service assurances.
- Institutional and Organizational Use Notice
- No administrative dashboards, reporting, or roster integrations are included.
- No onboarding, implementation services, instructional consulting, or account management are provided.
- Brighten Learning does not act as a school official for subscriptions purchased through third‑party marketplaces.
- Institutional services and managed access require a separate direct agreement.
- Regulatory and Compliance Notice
- Third‑party marketplace subscriptions are provided without regulatory, privacy, accessibility, or compliance representations or warranties.
- Brighten Learning does not provide compliance documentation, certifications, or audit participation for marketplace purchases.
- Brighten Learning does not enter into data protection or regulatory agreements, including Business Associate Agreements, through marketplace subscriptions.
- Compliance obligations require a separate direct agreement with Brighten Learning.
- Support Limitations
- Applications are provided on an as‑is basis through third‑party marketplaces.
- Support is limited to basic technical assistance related to application functionality.
- No instructional, compliance, accessibility, or institutional support is included.
- Third‑Party Marketplace Purchases and Refunds
- All billing, renewals, cancellations, and refunds must be handled through the marketplace where the purchase was made.
- Refunds are governed solely by the policies of the applicable marketplace.
- Brighten Learning cannot issue refunds for Apple App Store or Google Play Store purchases.
- No grace period is provided for third‑party marketplace subscriptions.
- Changes to this Agreement
- Brighten Learning may update this Agreement from time to time.
- The most current version will be posted at the published agreement URL.
- Continued use after an update constitutes acceptance of the revised Agreement.
- Governing Terms
- This Agreement supplements the Brighten Learning Terms of Use, Privacy Policy, and Acceptable Use Policy.
- In the event of a conflict, this Agreement governs third‑party marketplace subscriptions.
- Acceptance
- By purchasing or using a Brighten Learning application through a third‑party marketplace, you confirm acceptance of this Agreement and all referenced policies.
